Dow has its first close above 15,000 points

NEW YORK (AP) -- The Dow Jones industrial average is punching through another milestone: its first close above 15,000.

The Dow rose 87 points to 15,056 points Tuesday, a gain of 0.6 percent.

It was another milestone in the market's epic ascent in 2013. Good economic reports, higher corporate profits and support from central banks have eased investors' concerns that another economic slowdown could upend the market.

Two months ago the Dow recovered the last of its losses from the financial crisis. So far this year it's up 15 percent.

The Standard & Poor's 500 rose eight points to 1,625, also a record close. The Nasdaq rose four to 3,396, or 0.1 percent.

Three stocks rose for every one that fell on the New York Stock Exchange. Volume was light at 3.2 billion shares.

EU court gets T-Mobile Austria telecom merger appeal

VIENNA (Reuters) - T-Mobile Austria claimed partial victory on Monday in its legal battle against the allocation of radio frequencies resulting from rival Hutchison Whampoa's takeover of Orange Austria.

The Deutsche Telekom unit said in a blog entry on its website that an administrative court in Vienna had referred the case to the European Court of Justice.

T-Mobile said this confirmed its view that it had suffered a decisive competitive disadvantage by the spectrum allocation, which it says gives its rivals a major head start in building next-generation networks.

The administrative court declined to comment.

The ability to build an LTE (long-term evolution) network with data speeds up to 10 times those now available will be a competitive advantage in Austria's telecoms market.

T-Mobile appealed in December to the administrative court against the decision of Austria's telecom control commission, the TKK, for the transfer of frequencies that will accompany the merger that closed in January.

The frequencies T-Mobile will end up with are not adjacent, unlike those of Hutchison and the biggest operator, Telekom Austria, which also bought a package of frequencies.

T-Mobile said the Vienna court had asked the European court to rule quickly on the matter. If not, the case could create uncertainty around a September auction of frequencies that operators need to build superfast mobile broadband networks in Austria.

Austria aims to raise at least 526 million euros ($690 million) at that sale.

Bangladesh building-collapse toll climbs to 580

DHAKA, Bangladesh (AP) ? The death toll from the collapse of a shoddily built garment-factory building in Bangladesh continued its horrifying climb, reaching 580 on Sunday with little sign of what the final number will be.

It has been well over a week since the April 24 disaster, but each of the last several days has seen 20 or so bodies pulled from the mangled concrete, and sometimes much more than that.

The disaster is likely the worst garment-factory accident ever, and there have been few industrial accidents of any kind with a higher death toll. It surpassed long-ago garment-industry disasters such as New York's Triangle Shirtwaist factory fire, which killed 146 workers in 1911, and more recent tragedies such as a 2012 fire that killed about 260 people in Pakistan and one in Bangladesh that same year that killed 112.

Bangladesh's $20 billion garment industry supplies retailers around the world and accounts for about 80 percent of the impoverished country's exports. The collapse has raised strong doubts about retailers' claims that they could ensure worker safety through self-regulation.

Government officials say substandard building materials, combined with the vibration of the heavy machines used by the five factories, led to the collapse.

The building developed cracks a day before the collapse and the owner Mohammed Sohel Rana called engineer Abdur Razzak Khan to inspect it. Khan appeared on television that night and said he told Rana the building should be evacuated.

Police also issued an evacuation order, but witnesses say that hours before the collapse, Rana told people that the building was safe and garment factory managers told their workers to go inside.

Rana has been arrested is expected to be charged with negligence, illegal construction and forcing workers to join work, crimes punishable by a maximum of seven years in jail. Authorities have not said if more serious crimes will be added.

Khan was arrested as well. Police said he worked as a consultant to Rana when three illegal floors were added to what was supposed to be a five-story building.

The government promised to make the garment industry safer after the November garment factory fire that killed 112 people, saying it would inspect factories for safety and pull the licenses of those that failed. That plan has yet to be implemented.

Bangladesh is popular as a source of clothing largely because of its cheap labor. The minimum wage for a garment worker is $38 a month, after being nearly doubled this year following violent protests by workers. According to the World Bank, the per capita income in Bangladesh was about $64 a month in 2011.

The ongoing debate about how a gay NFL player would be treated in the locker room has largely focused on the idea that times are changing, and that acceptance of a gay player would be a modern development. But it?s often overlooked that the ultimate example of the old-school football coach was also perfectly fine with having gay players on his team.

Multiple players who played for Vince Lombardi, the legendary former Packers and Redskins coach, say that he knew some of his players were gay, and that not only did he not have a problem with it, but he went out of his way to make sure no one else on his team would make it a problem.

In 1969, Lombardi?s Redskins included a running back named Ray McDonald, who in 1968 had been arrested for having sex with another man in public. In the Lombardi biography When Pride Still Mattered, author David Maraniss writes that Lombardi told his assistants he wanted them to work with McDonald to help him make the team, ?And if I hear one of you people make reference to his manhood, you?ll be out of here before your ass hits the ground.?

Lombardi?s daughter Susan told Ian O?Connor of ESPNNewYork.com that her father would have been thrilled to have a player like Jason Collins, the NBA center who publicly revealed this week that he is gay.

?My father was way ahead of his time,? Susan Lombardi said. ?He was discriminated against as a dark-skinned Italian American when he was younger, when he felt he was passed up for coaching jobs that he deserved. He felt the pain of discrimination, and so he raised his family to accept everybody, no matter what color they were or whatever their sexual orientation was. I think it?s great what Jason Collins did, because it?s going to open a lot of doors for people. Without a doubt my father would?ve embraced him, and would?ve been very proud of him for coming out.?

Dave Kopay, the first former NFL player to come out, also played on those 1969 Redskins, and he says that while he never told Lombardi, he believes Lombardi knew not only that Kopay was gay, but that Kopay and another Redskins player, Jerry Smith, were in a romantic relationship.

?Lombardi protected and loved Jerry,? Kopay told O?Connor.

Lombardi?s brother Harold was gay, and when Harold died in July of 2011 he was survived by his partner of 41 years ? meaning their relationship began just before Vince died in September of 1970. As noted by Doug Farrar of Yahoo! Sports, Vince knew Harold was gay and didn?t just believe in ?tolerance? but believed strongly that discrimination against gay people was wrong, just as he was angered when he saw mistreatment of his black players, or discrimination against his fellow Italian-Americans.

If a coach who was considered old-fashioned even by the standards of the 1960s accepted gay players in his locker room, the idea that gay players couldn?t be accepted in an NFL locker room in 2013 is both silly and sad.
