Spousal Privilege In Georgia May Be A Thing of The Past

Currently, a bill is being presented to the Georgia General Assembly that would eliminate Georgia?s law allowing a spouse to avoid having to testify against his or her spouse in a domestic violence case.? As alpharetta attorneys, this bill has its advantages and disadvantages.? The defense bar is clearly against the bill, arguing that its passage would severely curtail an accused?s rights to build proper defenses in criminal matters.? Proponents of the bill, such as prosecutors and family violence advocates, praise the bill as a solution to a long standing problem in prosecuting family violence matters.? There has alwaysbeen an exception to the spousal privilege rule in criminal cases involving a minor child.
